What do I do if I’m not sure I have a claim?

Set up a time for a meeting with an employment lawyer in our office for a 15-minute free discussion. If you want to consider a claim regarding the termination of your employment, Fair Work requires you to lodge your application within 21 days of the date of termination, so make sure you know the deadline.

Can you carry out a contract review for me?

Yes, we regularly review contracts from employees who have been offered a new position.  We can provide you with advice on the terms of the contract including important areas such as restraints of trade and remuneration packages.

Do you do ‘no win no fee’ work?

Generally, no, we do not operate on a no-win no-fee basis, as we are a boutique firm, and we are not set up to provide this service. We understand legal advice and representation can be outside some people’s budget, particularly if you are facing termination of employment, or have lost your job.

You can locate free resources on the Fair Work Commission’s website to assist employees in bringing their own claims. The Fair Work Commission is also designed to be a system in which employees can represent themselves.

We can provide you with advice to assist you in representing yourself, or putting together your own claim, or just provide you with guidance on whether you may have a claim.  Our fixed fee solution might be of assistance to you in these circumstances.

Do you offer fixed fee solutions?

It depends on the legal matter.

I’m being bullied and harassed at work. Can you assist?

Yes, we have helped many employees in this situation to understand their rights and help them navigate their way to a solution.

Employees who reasonably believe they are being bullied or sexually harassed can make an application to the Fair Work Commission pursuant to section 789FC of the Fair Work Act 2009 (Cth) for an order it considers appropriate to prevent the worker from being bullied and/or sexually harassed at work by an individual or individuals. Here is the required Form F72 which has further information about it. We can also provide you with advice and assistance in respect of such an application.

There may also be other options available to you depending on the nature of the bullying and harassment you are experiencing. It’s likely we will need to book a long consultation with you to be able to give you specific advice relevant to your situation, but you can book an initial complimentary call with our team so that we can have a chat about your issue and discuss how we might be able to assist you.

Do you also work for employers?
